Right-to-Know 

According to the Pennsylvania Right-to-Know Law, any legal resident of the United States can file a request. The term "person" is defined in the Statutory Construction Act as "a corporation, partnership, limited liability company, business trust, other association, government entity (other than the Commonwealth), estate, trust, foundation or natural person." The Township will deny anonymous requests on the basis that the requestor may not qualify as a "person" under Right-to-Know law.

Requesting Township Records:

Requests for records must be addressed to the Agency Open Records Officer (AORO)/Right to Know Officer (RTKO) and can be submitted by email, fax, mail, or in person.  The request should be specific and not seek answers to questions. 

The Township has five (5) business days to respond in writing to (1) grant the request; (2) deny the request, citing the legal basis for the denial or partial denial; or (3) invoke a 30-calendar day extension for certain reasons.

The clock starts the day after the RTK request is received during regular business hours. In other words, an agency has five business days to respond to a request, whether you place the request in person or by mail.

Filing an Appeal:

When a request is denied or deemed denied, a requester may file an appeal to the Pennsylvania Office of Open Records. The appeal must be filed within 15 business days of the denial or deemed denial date. The appeal must also include the request, agency denial if one exists, and address agency grounds that the request was denied.  An appeals officer will determine if the record(s) is subject to public access.
